These Terms of Service ("Terms") form a binding legal agreement between you ("you," "your," or "Customer") and OutletDomains.com ("OutletDomains," "we," "us," or "our"). By visiting our website, creating an account, purchasing a plan, or using any service we provide, you agree to be bound by these Terms in full. If you do not agree, do not use our website or services.
These Terms include important provisions: all sales are final, a mandatory arbitration clause, a class-action waiver, broad limitations of liability, and a strong indemnification clause. Read carefully — these affect your legal rights.

01Acceptance & Eligibility
By accessing or using OutletDomains, you confirm that you are at least eighteen (18) years of age, have the legal capacity to enter into a binding contract, and are not barred from receiving services under the laws of the United States or your jurisdiction of residence. If you are using OutletDomains on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms, and "you" includes both you personally and that entity.
These Terms apply in addition to our Privacy Policy, Refund Policy, and Disclaimer, each of which is incorporated by reference. By using OutletDomains, you agree to all of them.
02Account Registration
To purchase a plan or access the dashboard, you must create an account. You agree to:
- Provide accurate, current, complete information during signup and intake;
- Maintain and promptly update your information as it changes;
- Keep your password confidential and not share account access with unauthorized parties;
- Be responsible for all activity that occurs under your account;
- Notify us immediately at support@outletdomains.com of any suspected unauthorized access.
We may suspend or terminate your account at any time, with or without notice, if we suspect a violation of these Terms, fraud, abuse, or non-payment.
03Description of Services
OutletDomains offers website design, development, hosting management, social-media content production, paid-advertising management, and related digital business services. Specific services include but are not limited to Site In 72, Site In 72 + Social Boost, the Creator Site, and the Partnership Program. Features, pricing, and deliverables of each plan are described on the product pages and may be updated at our discretion.
Specific delivery timeframes — such as the 72-hour launch promise on the Site In 72 plan — apply only when you have submitted a complete intake form, provided all reasonably requested assets, and responded to project communications. Time you spend not responding does not count toward our delivery clock.
04Payment, Billing & All Sales Final
All plans are billed in advance. Subscription plans renew automatically each billing cycle until canceled. By providing a payment method, you authorize OutletDomains and its payment processor (Stripe) to charge that method for all amounts due, including subscription fees, prorated amounts, add-ons, taxes, and any applicable third-party pass-through costs.
All sales are final. See our full Refund Policy for details. By placing an order you affirmatively waive any right to a refund, credit, or chargeback for any reason not expressly listed in the Refund Policy. Failed payments may result in suspension or termination of services.
We reserve the right to change pricing on any plan with thirty (30) days' notice. Continued use after the effective date of a price change constitutes acceptance of the new price. Taxes, levies, and applicable government fees are your responsibility and may be added at checkout.
05Acceptable Use
You agree not to use OutletDomains or any site we build, host, or manage on your behalf for any unlawful, harmful, deceptive, or abusive purpose. Without limiting the foregoing, you may not:
- Promote, sell, or display content that infringes intellectual property, defames, harasses, or violates the rights of any person or entity;
- Sell or promote firearms (where regulated), illegal drugs, sexual services, gambling (where regulated), pyramid schemes, "get rich quick" scams, MLM-style recruitment-only programs, or any product or service that violates Stripe's restricted businesses list;
- Send unsolicited commercial email ("spam") from or about your site;
- Upload malware, viruses, or any code designed to harm a system or person;
- Attempt to reverse-engineer, decompile, or copy proprietary code, templates, designs, or systems we have built;
- Use our service to compete with us, including by reselling our services as your own;
- Misrepresent your identity, impersonate any person or entity, or falsely state affiliation with any person or entity;
- Bypass, disable, or otherwise interfere with any security-related features of our service.
We may terminate your account immediately and without refund if you violate this section.
06Your Content
You retain ownership of all original content you supply to us — copy, logos, photos, video, customer lists, and other materials ("Your Content"). You grant OutletDomains a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, host, distribute, and adapt Your Content for the purpose of providing the services you have purchased, including building, updating, marketing, and supporting your website and related campaigns.
You represent and warrant that (i) you own or have all rights necessary to grant this license, (ii) Your Content does not infringe any third-party intellectual property, privacy, or publicity right, and (iii) Your Content complies with all applicable laws. You agree to indemnify OutletDomains for any claim arising from Your Content.
07Our Intellectual Property
All software, templates, design systems, components, code libraries, marketing copy frameworks, illustrations, brand assets, and internal processes used by OutletDomains to deliver the services ("Our IP") are and remain the exclusive property of OutletDomains. Nothing in these Terms transfers any ownership of Our IP to you.
When you cancel a subscription, you may retain the design and content of the website we built so long as you replicate or migrate it yourself; we are not obligated to export, transfer, or migrate any underlying code, components, or proprietary systems. Specifically, we retain the right to reuse all underlying templates, designs, code patterns, and build systems for other customers.
08Third-Party Services
Our services rely on third-party providers including, without limitation, Stripe (payments), Supabase (authentication and database), Netlify (hosting), Cloudflare (DNS and CDN), Google (analytics and OAuth), Meta (advertising), and Calendly (scheduling). Their terms and privacy practices govern your relationship with them. OutletDomains is not liable for any failure, outage, data loss, or policy decision of a third-party provider, including the suspension of a payment processor account, advertising account, or social media account.
09Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, OutletDomains disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the services will be uninterrupted, error-free, secure, or that any particular result, traffic level, conversion rate, lead volume, or revenue level will be achieved.
10Limitation of Liability
To the maximum extent permitted by applicable law, OutletDomains, its officers, employees, contractors, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost revenue, lost data, business interruption, or goodwill — arising out of or in connection with your use of the services, even if we have been advised of the possibility of such damages.
In all cases, OutletDomains' total cumulative liability to you for any and all claims arising out of or related to these Terms or your use of the services shall not exceed the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so some of these limitations may not apply to you.
11Indemnification
You agree to defend, indemnify, and hold harmless OutletDomains and its officers, employees, contractors, agents, affiliates, and licensors from and against any and all claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (i) your use of the services; (ii) Your Content; (iii) your violation of these Terms; (iv) your violation of any law or regulation; or (v) your violation of any third-party right, including any intellectual property, publicity, or privacy right.
12Termination
We may terminate or suspend your account and access to the services at any time, for any reason, with or without notice, including for breach of these Terms, suspected fraud, abuse, non-payment, chargeback initiation, or violation of acceptable use. Upon termination:
- Your right to use the services ends immediately;
- Your hosted website, dashboard, and edit-request system will be deactivated;
- No refunds or credits will be issued;
- Sections of these Terms that by their nature should survive (including IP, indemnification, limitation of liability, arbitration, and governing law) will survive termination.
13Arbitration & Class-Action Waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of OutletDomains — including the validity, formation, scope, interpretation, breach, or enforcement of these Terms — shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court, except that you may assert claims in small-claims court if your claims qualify.
Arbitration will take place in Maricopa County, Arizona, before a single neutral arbitrator. The arbitrator's award shall be final and binding. Judgment on the award may be entered in any court having jurisdiction.
YOU AND OUTLETDOMAINS AGREE TO BRING ANY DISPUTE ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
14Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws principles. To the extent any claim is not subject to arbitration, the exclusive venue shall be the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction therein.
15Changes to These Terms
We may update these Terms at any time. The "Last Updated" date at the top of this page indicates when changes were made. Material changes will be communicated by email or by a notice on the website. Continued use of OutletDomains after a change becomes effective constitutes acceptance of the updated Terms.
16Miscellaneous
Entire agreement
These Terms, together with the Privacy Policy, Refund Policy, Disclaimer, and any plan-specific agreement, constitute the entire agreement between you and OutletDomains regarding the services.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
Waiver
No waiver of any provision shall be effective unless in writing and signed by OutletDomains.
Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms freely.
Force majeure
Neither party is liable for any failure or delay due to causes beyond reasonable control, including natural disasters, acts of war, government action, or failure of third-party providers.
No partnership
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship, except where explicitly stated in a separate Partnership Program agreement.
